1. Our Services & Scope of Work

The Apparel Solutions provides professional design, conversion, and manufacturing services across three primary service sectors:

• Digitizing for Embroidery: Converting client-submitted artwork into technical, machine-readable digital embroidery files (e.g., .DST, .PES, .EMB).
• Vectorizing Services: Transforming low-resolution raster images, drawings, or sketches into scalable, high-resolution vector graphic assets (e.g., .AI, .EPS, .PDF).
• Custom Patches (Physical Production & Shipping): The manufacturing, physical production, and global shipping of custom-embroidered, woven, or PVC patches tailored to client specifications.

2. Client Responsibilities & Intellectual Property Warranty

• Artwork Ownership: By submitting any logo, design, trademark, text, or graphic layout to The Apparel Solutions for digitizing, vectorization, or custom patch production, you (the “Client”) explicitly warrant that you are the legal owner of the artwork, or that you have obtained official, written permission from the copyright or trademark holder to use and reproduce it.
• Copyright Indemnification: The Apparel Solutions respects intellectual property rights and will not knowingly reproduce copyrighted logos without authorization. You agree to indemnify, defend, and hold harmless The Apparel Solutions, its operators, and employees from any and all claims, liabilities, damages, or costs (including legal fees) arising from any copyright or trademark infringement claims related to the design assets you provided.

3. Payment, Currency, and Billing

• Payment Terms: Payment must be made in full before production, technical digitizing, or vector drafting begins.
• Currency and Security: All international and local transactions are securely processed through our authorized, PCI-compliant third-party payment gateways in the currency specified during the checkout or invoice process. We do not store your credit card or financial information on our servers.

4. Physical Production, Shipping, and Delivery

For our custom patch production, the following terms apply:

• Production Timeline: Production begins only after the final digital or physical sample proof is formally approved by the Client. Estimated production timelines will be provided upon order placement.
• Shipping & Transit: We ship our physical products internationally using reliable courier networks. While we provide tracking details and estimated delivery dates, The Apparel Solutions is not responsible for shipping delays caused by customs clearance procedures, courier backlogs, or force majeure events.
• Customs Duties and Taxes: The Client is solely responsible for any import duties, customs fees, or local taxes levied by their destination country upon arrival of physical patch shipments.

5. Revisions and Quality Assurance

• We aim for maximum machine compatibility and design accuracy. The guidelines governing digital file modifications, stitch density edits, sizing adjustments, physical patch sample approvals, and payment disputes are strictly managed under our separate Refund and Revision Policy, which is incorporated into these Terms.
